The Forensic expert kollegium conducts psychological studies of persons who have been subjected to violence to confirm the facts of the use of physical or moral violence.

In this type of study, a retrospective diagnosis of the mental state at the time of the commission of violence (moral or physical, including sexual), an assessment of post-traumatic stress, determination of the fact of moral damage caused by violence, a psychophysiological study using a contact polygraph (for subjects over 14 years old) is carried out.

The following questions can be put to resolution during this psychological study:

  • Is there ideal trace information in the memory of the victim regarding ... (the committed fact of violence)?
  • Does the victim have individual psychological characteristics that contribute to erotic and sexual fantasies?
  • What mental state was the victim in before, during and after the commission of unlawful actions against him/her, what were the dynamics of the development of these states?
  • Considering the level of psycho-sexual development of the victim, the specific features of the situation, his/her emotional state, was he/she able to resist?
  • Could the victim resist during and after the unlawful actions were committed against him/her?
  • Taking into account age characteristics and level of intellectual development, could the victim understand the nature and significance of the actions performed on him/her? (for children under 14 years old)
  • Does the victim have psychological trauma? If so, is it causally related to the actions of the alleged or identified aggressor?
  • Are psychological and psychophysiological signs of post-traumatic stress disorder and (or) other specific syndrome complexes identified? If yes, what is the specificity of their etiology and pathogenesis?

Psychological research to confirm the use of violence is carried out only with the voluntary consent of the person who have been subjected to violence.

Psychological research to confirm the use of sexual violence against minors is also carried out with the written consent of the legal representative (father, mother or guardian) of the minor under examination.

When conducting a psychological study of children under 12 years of age, it is desirable that the child’s legal representative would be present during the study.
