The Forensic expert kollegium conducts expertise of goods and services on the basis of one of the following documents:
- an application for conducting expertise;
- a letter from a state consumer protection authority requesting a commission or comprehensive expertise or expertise for the purpose of protecting the rights of an indefinite group of consumers.
An application for conducting expertise of goods or services may be written by the consumer, seller, manufacturer of the goods, or a repair organization.
The consumer has the right to demand payment for the examination from the seller, manufacturer, supplier of the goods, representative, or service provider (repair or service organization), or to pay for the examination independently.
If the consumer demands payment for the examination from the seller, manufacturer, supplier of the goods, representative, or service provider (repair or service organization), the application for conducting expertise is written by the consumer addressed to the relevant legal entities.
If the consumer wishes to pay for the examination independently, the application for conducting expertise is written by the consumer addressed to the Director of the Forensic expert kollegium, LLC (Genady Ignatkovich).
If the consumer demands payment for the expertise conducting from the seller, manufacturer, supplier of the goods, representative, or service provider (repair or service organization), the payer of the examination must conclude an appropriate contract for expertise conducting. A legal entity may conclude a one-time or ongoing contract with the Forensic expert kollegium for conducting expertise. In the latter case, the payer for conducting examinations of goods or services is provided with a set of documents, including a list of labor costs for various goods and (or) services expertise conducting, application forms for expertise conducting, forms of acts for transferring goods for expertise and transferring goods after the examination, typical questions to be resolved during goods and (or) services expertise.
In the case of concluding a contract for conducting an examination in written form, an application may not be required.
The Forensic expert kollegium draws special attention to the fact that only independent expertise is conducted in our forensic institution, therefore the conclusions of the examinations are in no way influenced by which party is the payer of the examination.
To prevent misunderstandings after the examination, the seller, manufacturer, supplier of the goods, representative or service provider (repair or service organization) is obliged to familiarize the consumer with the Regulation on the procedure for conducting expertise of goods (results of completed works, rendered services), reliability of information about goods (works, services), approved by the Resolution of the Council of Ministers of the Republic of Belarus dated 14.01.2009 No. 26, and with the approximate cost of conducting expertise of goods (services). The legal entity - payer for expertise conducting also has the right to warn the consumer about liability for providing false information about existing defects of the goods and about payment of the full cost of conducting the examination of the goods and transportation costs in the absence of the claimed defects.
Below is the application form for conducting expertise in accordance with the Resolution of the Council of Ministers of the Republic of Belarus dated 14.01.2009 No. 26 for completion by the consumer of goods or services.
