The Forensic expert kollegium conducts all types of auto-technical expertise in the judicial and pre-trial order.
Auto-technical expertise is one of the applied types of scientific and technical examinations, the need for which is constantly increasing with the growth of motorization in the country. This growth is accompanied by constant improvement, complication and rise in the cost of vehicles, increasing requirements for their maintenance and repair quality. Unfortunately, the level of service of vehicles is not always adequate to the requirements imposed on it, which entails the emergence of relevant disputes, often having a very significant material component. Also, very relevant is the constant increase in the amount of damage from road traffic accidents (hereinafter RTA), the severity of the punishment of their perpetrators, which makes as drivers and other traffic participants, as well as vehicle owners and insurance companies interested in establishing the true circumstances of the accident. In most cases, all kinds of issues related to road accidents, the quality of repair and maintenance of vehicles can be fully and reliably resolved only through the use of special technical knowledge in the field of auto-technical expertise.
The objects of auto-technical expertise are:
- vehicles, their parts, assemblies, mechanisms, fragments;
- road (traffic situation), the place of the accident, footprints and tracks traced on the vehicle and the road;
- data contained in the materials, submitted for the study and not requiring legal assessment.
The subject of auto-technical expertise is the actual data:
- about the technical condition of the vehicle;
- about the traffic situation at the accident site;
- about the mechanism of development of a road accident;
- about the circumstances that led to an accident, or to a technical malfunction of the vehicle.
The expert establishes the listed factual data on the basis of his special knowledge, materials of a criminal or civil case, administrative offense, official investigation, as well as on the basis of other materials of civil law relations.
A feature of auto-technical expertise is its broad focus and the associated need for experts to have knowledge in various fields (law, forensics, theory and design of vehicles, technology for their manufacture, repair and maintenance, metal science, organization and road safety, medicine, IT technologies etc.). These requirements impose on experts the highest requirements for their qualifications, and therefore, carrying out an auto-technical examination at various stages of the consideration of the case will provide not only professional assistance in resolving the issues that have arisen, but also the elimination of potential and current material costs.
Thus, carrying out an auto-technical examination (both judicial and pre-trial), as a rule, can provide:
- effective consideration of criminal and civil cases, administrative materials;
- resolution of disputes between the car service company (or other repair company) and the customer on the quality of the rendered repair (maintenance) service of the vehicle (repair of units, assemblies);
- resolution of disputes between the buyer and the seller on the quality of the goods (vehicle, individual parts, components and assemblies) that are in the warranty period of operation;
- establishing the actual circumstances of an accident (or other incidents) with determining the sequence and extent of damage to a vehicle, determining the possibility of their occurrence in a particular road accident, restoration of the mechanism of the development of the accident.
According to the decree of the State committee of forensic expertise of the Republic of Belarus from May 15, 2014, No. 8 (as amended by the resolution of the State committee of forensic expertise of the Republic of Belarus on February 29, 2016, No. 13), forensic auto-technical expertise as a type of expertise is divided into the following subspecies:
- expertise of the technical condition of parts and assemblies of vehicles;
- transport and trace expertise;
- establishing the circumstances of a road traffic accident by calculation methods.
