In accordance with the Decree of the Council of ministers of the Republic of Belarus № 26 dated January 14th, 2009, the Forensic expert kollegium conducts goods and services expertise.
Expertise of the quality of goods and services are carried out by certified forensic experts of the appropriate profile and qualified metrology engineers at their own test base, consisting of certified test equipment and measuring instruments duly registered by the State committee for standardization of the Republic of Belarus, included in the State register of measuring instruments and having passed the primary and periodic state verification (calibration).
Using our own measuring and testing equipment allows our organization to carry out the quality of goods and services expertise in the shortest possible time.
Using verified measuring instruments and certified test equipment makes it possible to obtain reliable and reproducible control results recognized by all accredited testing laboratories of the State standard of the Republic of Belarus, as well as by all levels of forensic and investigative authorities.
The production of the quality of goods and services expertise in the presence of all interested parties makes it possible to ensure the transparency of the process and the validity of the conclusion of the expertise.
The production of quality expertise of goods and services by certified forensic experts, defectoscopists and qualified metrology engineers allows obtaining competent conclusions from an independent quality expertise, recognized by all interested parties in pre-trial and forensic procedures.
The purpose of the expertise of goods (results of work performed, services rendered) and reliability of information about goods (works, services) is:
- establishing (confirming) the fact of the presence of defects in the product (work performed, service rendered) and determining the causes of these defects;
- assessment of the reliability of information provided to consumers about the product (works, services).
Expertise of goods (results of work performed, services rendered), reliability of information about goods (works, services) may be carried out by:
- accredited certification for goods or services bodies;
- accredited testing laboratories (centers);
- state forensic institutions and persons having special permits (licenses) to carry out activities for the provision of forensic expert activities;
- chambers of commerce and industry - on the quality of goods;
- consumer associations.
If the above-described expert organizations refuse to conduct the expertise, the right to conduct the expertise have:
- repair organizations, with the exception of repair organizations authorized to eliminate deficiencies and (or) maintain goods by manufacturers (sellers, suppliers, representatives) who have manufactured (sold) goods which are the subject to expertise;
- manufacturers (performers), with the exception of manufacturers (performers) who have manufactured goods (performed works, rendered services) which are the subject to expertise.
The Forensic expert kollegium conducts expertise on the basis of one of the following documents:
- applications for expertise;
- letters from the State body for the protection of consumer rights on carrying out of a commission or complex expertise in order to protect the rights of an indefinite number of consumers.
In the case of conclusion of a contract on carrying out an expertise in writing form, the application may not be drawn up.
Payment for the expertise of goods (results of work performed, services rendered), the reliability of information about goods (works, services) is made by:
- the seller, manufacturer, supplier, representative or performer who submitted the application, in the amount and terms determined by the expert organization;
- the seller, manufacturer, supplier, representative or performer specified in the application, letter, in the amount and terms determined by the expert organization - when the consumer submits the application or submits the letter by the State body for the protection of consumer rights.
The consumer has the right to independently pay for the expertise.
Conducting an expertise in the interests of an indefinite circle of persons at the initiative of the State body for the protection of consumer rights is carried out at the expense of the seller (supplier, representative, manufacturer).
The Forensic expert kollegium has the right to refuse to carry out an expertise if the payment is not made by the relevant person in the amount and terms determined by the Forensic expert kollegium.
The Forensic expert kollegium, in agreement with the applicant (the State body for the protection of consumer rights), determines the specific time for carrying out the expertise.
If the applicant is the seller, manufacturer, supplier, representative or performer, he is obliged to inform the consumer about the place and time of the expertise in writing form.
The consumer has the right to take part in the expetise personally or through his representative.
Damage to goods (results of work performed) during the expertise is not allowed, except the cases when such damage is caused by the nature of the expertise.
The expert organization is obliged to inform the applicant about the possibility of damaging goods (results of work performed) during the expertise. If the applicant is a seller, manufacturer, supplier, representative or performer, he is obliged to inform the consumer in writing form about the possibility of damaging the goods (results of work performed) during the expertise.
When establishing (confirming) the absence of violations on the part of the seller, manufacturer, supplier, representative or performer, or the absence a causal relationship between their actions and defects found in the product (the result of the work performed) in the result of the expertise, the consumer is not compensated for losses associated with damaging the goods ( result of the work done).
The goods (results of work performed) are returned to the person who provided them after the expertise.
The expert has the right to open the seals of the goods, as well as to seal the goods after the expertise. The fact of opening the seal and sealing the goods is reflected in the expert report. The opening of the seal of the goods by the expert is not a basis for the termination of warranty obligations regarding these goods.
