Among the most common issues addressed during expertise of construction facilities and functionally related territories are the quality, scope, and cost of completed design works. The subject matter of such expertise includes case circumstances related to establishing facts that characterize the process of pre-design and design work execution, as well as the final design outcomes.
Based on expert practice, such issues frequently arise following the termination of design service contracts (i.e., when the work has not been completed) between the Client and the Designer. The main reasons for contract termination and subsequent appointment of an expertise include: poor quality of design work, reduction of the contractual scope of design work, failure to comply with the project schedule, the absence of a need to complete the design work (Client’s position), or failure to provide the necessary source data for certain design sections and non-compliance with the financing schedule (Designer’s position).

- Does the quality of the design documentation sections prepared by the designer for the project: “XXX” comply with the requirements of Contract No. XX dated XX.XX.XXXX and applicable technical regulations and legal acts?
- Has the design organization completed all works stipulated under Contract No. XX dated XX.XX.XXXX in full?
- Do the volumes of work performed by the contractor for Sections XXX and XXX correspond to the value of work specified in Contract No. XX dated XX.XX.XXXX for the respective sections?
- Are sections XXX and XXX of the design documentation complete (i.e., have all required works been performed and all appendices, plans, drawings, schemes, etc. been developed by the designer)?
The common objects of such expertise include:
- design services contract;
- design brief (terms of reference);
- architectural and planning assignment;
- payment schedule;
- design work schedule (issuance of design and estimate documentation);
- cost estimates substantiating the contract price and calculating the cost (scope of required work) of design and survey services;
- source data provided to the designer;
- technical specifications for design;
- architectural (construction, conceptual) design documentation.
As a rule, such expertise do not require a site inspection. They are classified as highly complex expert examinations and require the highest level of qualification from a forensic construction expert.
