The Forensic expert kollegium conducts all types of auto-technical expertise in both judicial and pre-trial proceedings.

The expertise of road traffic accident circumstances (hereinafter referred to as an “RTA”) using calculation methods is one of the subtypes of automotive forensic expertise.

To provide an understanding of the capabilities of this subtype of automotive forensic expertise, as well as to explain its scope, a brief description of the examination objectives and the most typical questions addressed during the expertise (provided that the necessary source data and proper condition of the examination objects are available) is presented below.

The RTA circumstances expertise includes the expert analysis of road traffic situations (RTS), calculation of the movement parameters of vehicles, other objects and pedestrians during the RTA, as well as the analysis of drivers’ actions and capabilities.

The objects of expertise of road traffic accident circumstances using calculation methods are data contained in the materials submitted for examination that do not require legal assessment.

The subject matter of the expertise of road traffic accident circumstances using calculation methods consists of factual data concerning the circumstances of the RTA, the mechanism of its development, road conditions, the technical condition of the vehicle, the actions of the RTA participants, etc.

Within the framework of the expertise of road traffic accident circumstances using calculation methods, the following tasks are addressed:

  • Determination of the movement parameters of vehicles and other road users, as well as their relative positions during various phases of the RTA (speed, distance from the accident location at specific moments, braking distance, stopping distance, position on the roadway while performing a maneuver, etc.).
  • Determination of whether the driver of a vehicle had the technical possibility to prevent the RTA at a specific moment (the moment when an obstacle or danger to traffic arose that the driver was able to detect) by taking actions prescribed by traffic regulations to avoid the incident.
  • Determination of whether the driver’s actions complied with the requirements of traffic regulations.

Based on the expert practice of the Forensic expert kollegium, the following questions are most frequently submitted for resolution in expertise of road traffic accident circumstances using calculation methods:

  • What was the speed of the vehicle before braking was applied?
  • What was the possible cause of the vehicle skidding (overturning)?
  • What was the stopping distance (braking distance) and stopping time of the vehicle in a specific road traffic situation and road conditions?
  • Did the driver have the technical possibility to prevent the RTA at the moment an obstacle or danger to traffic arose that the driver was able to detect?
  • From what position on the roadway did the vehicle begin the turning/U-turn maneuver before the RTA occurred?
  • Did the actions of the vehicle driver in the situation under consideration comply with the requirements of traffic regulations?

The above list and content of questions are indicative. In each specific case, they may be expanded and detailed to the extent necessary and proportionate to the tasks to be resolved in a particular situation. Therefore, in order to clarify the questions and avoid situations in which it would be impossible to provide answers to them, a preliminary consultation is generally required. During such a consultation, the available materials and documents will be preliminarily reviewed, and recommendations will be provided regarding the submission of additional information or other objects.

Expertise of road traffic accident circumstances at the Forensic expert kollegium are carried out using various methods (calculation methods, expert assessment methods, and modeling using the licensed PC Crash software), which are selected by the expert individually according to the specific examination task and the questions submitted for resolution.
