The Forensic expert kollegium performs expertise for determining the scope and cost of completed works in both judicial and pre-trial proceedings.
An examination aimed at determining the scope and cost of completed works is carried out both in cases of disputes between a client and a contractor (expertise of the scope and cost of completed works upon completion of construction, reconstruction, or repair) and during construction, reconstruction, or repair for the purpose of technical supervision of the performed works. The examination also makes it possible to identify the value of paid but unperformed works that were stipulated by the contract.
During the expertise, the following activities are carried out by the Forensic expert kollegium:
- on-site inspection of the object;
- performance of measurement works at the site;
- review and analysis of materials provided for examination (for example, photographic materials showing the condition of the object before the performance of the works under examination);
- comparison of the data specified in the materials with the results established during the actual inspection;
based on the actual measurement results and the conducted examination, a calculation of the cost of the actually completed construction and repair works is prepared using prices valid as of a specified date.
The calculation of the cost of works and materials is performed in accordance with the methodology effective in the Republic of Belarus since January 1, 2012, which is mandatory for calculating the cost of construction, installation, and repair works in compliance with the requirements of Decree of the President of the Republic of Belarus No. 361 of August 11, 2011. In addition, NRR 8.01.104-2012 “Methodological Guidelines for the Application of Resource Consumption Standards in Physical Terms” are used in determining costs.
The cost of materials not specified in the national regulatory database of current resource prices is determined based on the average retail price of similar materials at the time of the examination, taking into account dimensions, technical characteristics, country of manufacture, and a cost adjustment coefficient determined by the ratio of its value at the time of the examination to its value as of a specified date.
The cost of similar materials is determined on the basis of information from specialized construction periodicals, as well as prices established by manufacturers and distributors, prices at construction markets and building supply stores, and is calculated as the average retail price for similar goods.
The following questions may be submitted for resolution during the expertise conducted by the Forensic expert kollegium:
- What are the scope and quality of the completed construction, repair-construction, and restoration works (specify the address of the examined object) at prices valid as of (specify the date)?
- What is the cost of the completed construction, repair-construction, and restoration works (specify the address of the examined object) at prices valid as of (specify the date)?
The expertise is carried out by specialists who possess higher education in civil engineering and specialized training in the field of forensic construction and technical expertise.
Examination of expertise objects is performed through visual inspection of their condition, as well as the necessary control measurements and dimensional checks, with results recorded on site and subsequent determination of work volumes based on the obtained factual data. Inspections are carried out using calibrated measuring instruments and auxiliary equipment entered into the State register of measuring instruments of the Republic of Belarus.
Based on the results of the examination, the fact of completion of construction, repair-construction, and restoration works at the examined object is identified and documented, specifying the exact list of works performed and their scope.
