The Forensic expert kollegium conducts all types of auto-technical expertise in both judicial and pre-trial proceedings, one of the objects of which is data contained in the materials submitted for examination and not requiring legal assessment.

The evidentiary value of an auto-technical forensic expertise in a particular case (incident) largely depends on the quality of the materials and source data submitted for examination.

A number of objects of auto-technical forensic expertise may, to one degree or another, be preserved and submitted for examination (vehicles, their individual parts, assemblies and units, etc.). Another category of objects (the scene of a road traffic accident, traces on the road and surrounding objects, road conditions, weather and meteorological conditions) can, in most cases, only be examined based on case materials in which their condition at a particular point in time has been documented.

As a rule, these data are recorded in the scene inspection report, the accompanying diagram, the vehicle inspection report (act), as well as in other documents and on other information carriers. The expert may independently accept and examine these source data within the scope of the questions submitted for resolution if there are no clarifications or explanations from the party commissioning the examination (the authority conducting criminal, administrative or civil proceedings).

Other source data (information contained in eyewitness explanations, interview records of participants and witnesses of the incident, records of procedural actions, other expert examinations and studies) generally require legal assessment (a comprehensive, complete and objective evaluation) of all evidence collected in the case. Since the legal assessment of evidence falls outside the expert’s competence, the expert may use source data from the case materials only upon instruction from the inquiry authority, investigating authority or court. Such source data are set out either directly in the resolution or ruling appointing the examination, or are additionally provided in response to an expert’s request for the submission of the relevant source data or materials necessary for conducting the examination and preparing an opinion on the questions submitted for resolution.
